1. Acceptance of Terms
By accessing or using the Simpatico HR platform ("Service"), operated by Simpatico HR Consultancy ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Simpatico HR provides a cloud-based Human Resources Management System (HRMS) and Applicant Tracking System (ATS) that includes recruitment automation, payroll processing, employee management, AI-powered assessments, attendance tracking, and related HR tools.
3. Account Registration
You must provide accurate, complete information when registering. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.
4. Subscription Plans & Billing
- Free Trial: New accounts receive a 2-day free trial with limited features. No payment information is required during the trial.
- Paid Plans: Subscription fees are billed monthly or annually as selected. All prices are listed on our Pricing Page.
- Payment Processing: All payments are processed securely by Razorpay, our PCI DSS Level 1 certified payment gateway.
- Auto-Renewal: Subscriptions auto-renew unless cancelled before the current billing period ends.
5. Data Ownership & Privacy
You retain full ownership of all data you upload to the Service. We process your data in accordance with our Privacy Policy. We implement industry-standard security measures including encryption, row-level security, and tenant isolation.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of applicable laws
- Attempt to gain unauthorized access to other accounts, systems, or networks
- Upload malicious code, viruses, or harmful content
- Reverse-engineer, decompile, or disassemble any part of the Service
- Resell or redistribute the Service without written authorization
7. Intellectual Property
The Service, including its design, code, AI models, branding, and documentation, is the intellectual property of Simpatico HR Consultancy. You are granted a limited, non-exclusive, non-transferable license to use the Service during your subscription period.
8. Service Availability & Support
We strive for 99.9% uptime but do not guarantee uninterrupted availability. We may perform scheduled maintenance with advance notice. Support is provided via email at simpaticohrconsultancy@gmail.com.
9. Limitation of Liability
To the maximum extent permitted by law, Simpatico HR Consultancy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
10. Termination
Either party may terminate the agreement at any time. Upon termination, your access to the Service will cease. You may export your data within 30 days of termination. We reserve the right to suspend or terminate accounts that violate these terms.
11. Refund Policy
All sales are final. No refunds are provided for any subscription plan. We offer a free trial so you can evaluate the platform before purchasing. For full details, see our Refund Policy.
12. Modifications
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.
